Informed Consent before Prescribing Psychotropic Medications

According to Texas law, consent to giving psychotropic medication is valid only if:

  • The consent is given voluntarily and without undue influence and
  • The consenter receives information (given verbally or in writing) describing the:
    • Specific condition to be treated.
    • Benefits of the taking the medicine.
    • Most likely physical and mental health outcome of not consenting to the medicines.
    • Most likely (clinically significant) side effects and risks associated with the medicines.
    • Generally accepted alternative medication and all other interventions that don't involve medicines, if any, and the reason for the proposed course of treatment.
