This revision of the Child Protective Services Handbook was published on February 1, 2016.
CPS wants to ensure that the general public understands what critical actions caseworkers are required to perform and why. Abortion and Judicial Bypass (PATS 8817)
This new item and revision reflect changes arising from HB 3994, 84th Legislature, Regular Session, 2015. A caseworker must consult with law enforcement if the caseworker investigates and substantiates a report of suspected physical or sexual abuse made by a physician performing an abortion or by a judge or justice of the peace presiding over a judicial bypass hearing. The caseworker must refer the matter for prosecution if law enforcement does not refer the matter.
