Assessment of Reports for Day Care Licensing When Information is Limited
This is a clarification to provide guidance to SWI staff on whether to send an intake or a Possible Standards Violation I&R to Day Care Licensing (DCL) when information is limited at time of intake. This interpretation was provided to SWI by CCL state office staff.
If SWI is unable to gather enough information to determine whether or not a caregiver is subject to regulation, SWI sends an intake or a Possible Standards Violation I&R to DCL. In other words, unless SWI can determine with certainty that the caregiver is not subject to regulation, SWI must send an intake or I&R.
A caregiver may be subject to DCL regulation if all of the following conditions are met:
• The care is provided in the caregiver’s home,
• The caregiver is providing care to at least one unrelated child.
• The child is in care for at least four hours a day, three days per week, for three or more consecutive weeks, or the child is in care for four hours a day for 40 or more days in a period of 12 months.
Day Care Licensing staff have the additional expertise and resources to determine whether a caregiver is subject to regulation.
