Appendix I: Facilities and Jurisdictions

Introduction

APS staff members use this appendix to determine which state agency has jurisdiction (authority) to investigate allegations of abuse, neglect, or exploitation in certain settings.

This appendix provides the following information about various types of settings:

  • Services or Care Provided: The types of services or care that they provide.
  • Subject to Licensure: Whether, or under what circumstances, they are required to be licensed by a state agency.
  • Jurisdiction and Contact Information: Which state agency or program has jurisdiction over them, and its contact information. Some types of facilities have more than one agency or program listed; in this case, additional factors apply.

APS uses this site to help determine which state agency has jurisdiction over a particular setting.

This site can accept searches by the following:

  • Type of facility
  • Name of facility
  • Location

It may be necessary to leave out some information in order to get a result. (This is similar to how IMPACT works.) For example, a search should not include terms such as the following:

  • Drive, Street, or Road in the address.
  • Inc. in the facility name.

Adult Foster Care

No, if the facility serves three or fewer residents unrelated to the owner. (Example: A facility that serves the owner’s grandmother, plus three unrelated residents, does not require a license.)

Adult foster care homes for three or fewer residents may be either of the following:

  • Contracted through HHSC.
  • Neither licensed nor contracted.

Assisted Living Facilities

Yes. There are three types of licenses for assisted living facilities:

  • Type A and Type B – three or fewer residents unrelated to the owner.
  • Type C – four or more residents unrelated to the owner.

HHSC, if there are allegations of abuse, neglect, or financial exploitation by another person that occurred at the facility.

  • It is self-neglect.

Deaf Blind Multiple Disabilities (DBMD), Community Living Assistance and Support Services (CLASS), Medically Dependent Children Program (MDCP), Home and Community-Based Services (HCS), and Texas Home Living Waiver (TxHmL) Programs

  • Children with special medical needs.
  • Adults who qualify for admission to a nursing facility or ICF-IID but chose to remain in the community.

  • With family.
  • At a contracted foster care provider.
  • In a group home serving no more than four clients.

TxHmL offers the following services to people who live in their own homes or with their families:

  • Respite (rest or relief for caretakers).
  • Community support.
  • Day habilitation, including rehabilitation.
  • Other therapies.

The HCSSA providing services through the program is required to be licensed. DFPS sends HCSSA licensing concerns to HHSC.

HHSC certifies HCS and TxHmL settings through the Medicaid waiver program.
