8320 ICPC Placement and Courtesy Supervision Services

Requests for ICPC placement and courtesy supervision are sent from another state to the Texas ICPC State Office where they are reviewed and then forwarded to the appropriate regional ICPC liaison for referral to a contractor.

Once regional management has made the decision to contract out the ICPC Placement and Courtesy Supervision Services, a regional ICPC liaison may authorize these services according to regional guidelines.

8321 Determining Eligibility

Clients are eligible for ICPC Placement and Courtesy Supervision Services when:

  •  the sending state formally requests courtesy supervision, usually by using  Form 2261 Compact Report (ICPC 100-B);

  •  there is a court order appointing the sending state as the child's managing conservator, guardian, or agency responsible for the child's care and placement;

  •  there is a DFPS-approved home study in Texas;

  •  DFPS has recommended or approved the placement; and

  •  the child is placed.

If no formal request for courtesy supervision services is made, a regional ICPC liaison may authorize the services to support a child's placement by a sending state or to control risk factors.

8322 Identifying Available Services

The ICPC Placement and Courtesy Supervision Services available through the contract must include the following:

  •  Face-to-face contact with ICPC clients;

  •  Consultation with CPS workers, including regular staffings with the regional ICPC liaison or other appropriate person;

  •  Consultation with other professionals involved in the case;

  •  Consultation with child protective services agencies in other states necessary to adequately provide the services (such as, obtaining current court documents and plans of service, and so on);

  •  Written supervision reports every three months;

  •  Court testimony, as requested; and

  •  A final written report recommending legal action to complete the interstate-placement process.

8323 Referring Clients

In addition, the regional ICPC liaison should forward to the contractor:

  •  a copy of the completed and approved home study; and

  •  any other documentation that would be helpful to the contractor.

If the referral is for an adoptive placement and courtesy supervision, then the regional ICPC liaison must also forward to the contractor:

  •  proof that the child is legally free for adoption; and

  •  an adoptive home study approved by DFPS in Texas.

8324 Using IMPACT

8324.1 When IMPACT is Unavailable

If the IMPACT system is not functioning or the worker is otherwise unable to access it, the worker may authorize ICPC Placement and Supervision Services by submitting a paper copy of Form 2054, Service Authorization.

8325 Handling Additional Duties

The regional ICPC liaison must perform the following additional duties:

  •  Review and approve ongoing supervision reports;

  •  Submit an original and two copies of each supervision report to the ICPC State Office;

  •  Forward to the contractor any additional information received from the ICPC State Office or the sending state;

  •  Review and approve, or submit for approval, the contractor's documentation of need for Evaluation and Treatment Services; see 8330 ICPC Evaluation and Treatment Services;

  •  Notify the contractor concerning the approval for the Evaluation and Treatment Services; and

  •  Review and approve the final supervision report recommending legal action to complete the interstate placement process.

8326 Adding, Extending, Reauthorizing, or Closing Services

To authorize additional units of service, or extend or reauthorize the service, see 8161.1 Active Cases — Authorizing, Extending, or Terminating Direct Services

A case may be closed only if the sending agency:

  •  removes the child from the supervising caregiver, or

  •  loses legal jurisdiction of the child.

However, the contractor must:

  •  complete a supervisory report recommending a legal action that will complete the case, and

  •  send an original and two copies of the report to the ICPC state office for concurrence with the recommendation and transmittal to the sending state.

If the sending agency concurs with the recommendation, that agency should submit:

  •  a new Form 2261, Compact Report (100-B), specifying the date and contents of the court order;

  •  the court order;

  •  a letter that specifies the date and contents of the court order; or

  •  any combination of the above.

When the above documents are received, the regional ICPC liaison retires the case file.

The contractor or the ICPC regional liaison must maintain the original closed file for five years and 90 days.

Terminating Before the End Date

If the service is being terminated before the end date on Form 2054, Service Authorization, the regional ICPC liaison must follow 8161.1 Active Cases — Authorizing, Extending, or Terminating Direct Services.
