Handling Criminal History Record Information (PATS 14003)

House Bill (HB) 4123 (88th Texas Legislature) makes modifications to the law relating to the obtaining and releasing of criminal background check information from the FBI and Texas Department of Public Safety. DFPS is now required to destroy criminal history information after its authorized purpose.

In response to the passage of HB 4123, DFPS Records Management Group (RMG) policy 2540 Handling Criminal History Record Information (CHRI) was updated. This policy provides overarching guidance for DFPS in relation to CHRI.

Please be advised that how DFPS currently handles CHRI was significantly impacted by passage of HB 4123. Policy now directs DFPS staff to shred CHRI after review and refrain from retaining CHRI in IMPACT (including in a narrative form).
